PRICING & CANCELLATIONS

SECTION 1 – PAYMENT POLICY

Fees are charged either on an hourly or monthly basis or on any other basis agreed with the individual Client and specified in the Client Agreement on a per-project basis. Additional fees will apply to items, services or products that may fall outside or extend a specific client agreement. These can include:

  • Errors, omissions or cancellations caused by the client.
  • Errors, omissions with third party providers.
  • The contract amount is agreed with the individual Client and specified in the Client Agreement.
  • Out-of-pocket expenses and the cost of supplies will be agreed upon with the Client.

Where there is a fixed price in the client agreement or phase plan, payments must be made in advance of the start of the application. Where the Client Agreement specifies a monthly subscription, we will charge you a standard monthly fee based on your account plan. The Service is billed in advance for each month and is non-refundable. There will be no refunds or credits for partial months of service, or refunds made should you not use the Service during a period of time when your account is open. No exceptions will be made.

You agree to pay the fee even if you later reject the work. If not specified in the Client Agreement, the minimum termination notice is 6 months, addressed to suzairaltaf@gmail.com. 

SECTION 2 – LIMITATIONS & EXCLUSIONS

In addition to any limitations or exclusions of liability specified elsewhere in these Terms or in the Client Agreement, the Company can accept no liability for any losses howsoever arising from:

  • Any loss or corruption of data howsoever arising
  • Any issues relating to internet services to which Clients’ PC’s and/or file servers may connect.
  • The acts or omissions of third parties including (but not exclusive to): suppliers of goods or services: This includes such suppliers engaged by the Client or the Company, either before, during or after the life of this contract. Any fire, flood, industrial action or other events beyond the reasonable control of the Company. 

SECTION 3 – TERM AND TERMINATION

The commencement and termination dates are specified in the Client Agreement. 

Termination:

The contract will come to an end automatically on the termination date specified in the Client Agreement.

Premature Termination by the Company:

The Company reserves the right to terminate before the termination date if the Client commits a fundamental breach of this agreement, including (but not exclusive to) asking the Company to do anything unethical or contrary to law.

suzairaltaf.com/Design Depths reserves the right to suspend or terminate this Agreement and your access to the Service with immediate effect if your account falls into arrears on the close of business on the 10th day of the month.

In this event, the contract will be terminated immediately by verbal notice. This verbal notice will then be confirmed in writing, delivered by hand, fax, email or Special or Recorded Delivery post. Termination is effective upon confirmation that the Client has received such written confirmation. The date of such confirmation then becomes the revised termination date. 

In the event of premature termination resulting from a fundamental breach by the Client, it is the Client’s responsibility to arrange for the completion of any outstanding work at their own expense.
